The FDA can regulate colorants ... see link below ... so color and solvent additives in pre-made pastes are within the authority and may be determined legal or illegal for use. PPD is deemed illegal for use on skin as a temporary tattoo! If I understand ... this means that pure henna is not illegal, but is not specifically APPROVED for use on skin, either. Milk, apricot paste, cucumber slices, honey, are also not APPROVED for use on skin, but they don't do you any harm. The FDA doesn't have the authority to approve or disapprove of putting cucumber moosh on your face. It doesn't fall into the area of things they rule on. Pure henna may be in that group, too. In any case .... I'd recommend anyone mix their own paste with only 100% natural pure henna, and stay far, far away from anything that doesn't have an absolutely complete list of ingredients especially colorants!
